Conditions of purchase and use of the website

1 – The Website Operator

The websites www.afoodtartufi.it and www.afoodtruffles.com are considered online B2B e-commerce sites, and therefore provided solely for the use of professionals and companies (hereinafter Users); as such, Italian Legislative Decree no. 206 of 6/9/2005, as amended, does not apply, particularly as regards the right to withdrawal and, more generally, the provisions that apply only to “Consumers”, in accordance with the Italian consumer code. 2 – Registration

In order to make use of the website’s services, the User is required to register, truthfully and accurately providing the data requested in the registration form and accepting the Privacy Policy and these general conditions. Users are responsible for safeguarding their credentials and shall be the sole party responsible for all activities performed with them.

3 – Products and Weight Loss

The information and characteristics of the products offered for sale are available on the web page dedicated to each product. The visual representation accompanying each product is an actual photograph of the product itself.

As fresh truffles are subject to a loss of weight, the quotation for the products offered on the site already includes an evaluation of the weight loss, and as such the Operator shall not accept any objections with regard to weight differences encountered upon delivery.

4 – Purchase Procedure

Prices are given in Euros, exclusive of VAT at the prevailing rate. The sale prices of the product may vary on the basis of sales agreements between the producer and the User. Shipping costs are not included in the individual product prices and will vary depending on the purchase amount and delivery destination, and are therefore expressly indicated in the order summary.

In order to complete the purchase procedure, Users must select the product, add it to their cart and complete the check-out process by entering their shipping and billing details before choosing the payment method. Receipt of order processing notification does not constitute acceptance of the order. A contract is entered into following payment of the purchase price and shipping fees indicated in the online order form. Users are required to make payment within fifteen (15) minutes, after which the product will no longer be held and will once again be available for purchase on the corresponding web page. Once the transaction has been confirmed, an order confirmation message will be displayed.

Orders are always final. Once the Operator has received the order, it shall be considered final and the products will immediately be prepared for shipping; any additions will be treated as a new order.

5 – Delivery Terms

For orders received before 11:00 a.m., except in the event of accidents or force majeure, national/local holidays, remote delivery locations, or delays due to the delivery company, delivery will be made within:

Orders received after 11:00 will be shipped the working day following the order date.

Orders received on Friday will be shipped for delivery on Saturday (if the service is available for the area) and with an extra charge of 50 euro.

If a Saturday delivery is not available, the order will be processed and shipped on the working day following the order date.

Orders received on Saturday, Sunday or during bank holidays will be shipped the working day following the order date.

6 – Methods of Payment

The methods of payment available to the User are described on the order page (PayPal, credit card or other electronic payment systems). The Site Operator does not have access to the payment data provided by the User and the site does not store credit card details.

7 – Invoice

For each order taken, the Site Operator will issue an invoice which will be sent in electronic format to the email address given by the User during the registration process or can otherwise be downloaded from the dedicated area of the site.

8 – Delivery

Deliveries within Italy, the EU and Switzerland and Norway will be made by express courier during working hours within the timeframes specified on the order form, and shall be made to the specified delivery address, with the exception of delays, unforeseen circumstances or delays in customs processing (for Switzerland and Norway) which are not dependent on the Operator itself.

Delivery to countries outside of Europe may be made with Incoterms DAT, DDP or to the stated address (named place), depending on the availability of appropriate transport routes and vehicles, customs limitations and agreements made with the User. The Operator reserves the right to refuse orders which cannot be delivered within a reasonable timeframe due to customs restrictions, or due to a lack of appropriate transport or the import authorisations required by the User. The delivery times, where possible, will in any case be specified on the order form, with the exception of delays or unexpected issues outside of the control of the Operator. If you wish to place an order for delivery outside the EU, we suggest you contact our customer service department in advance to check delivery feasibility and discuss the best approach.

Upon delivery, the User must check the number of packages and that they are not damaged, in the presence of the courier or airport operator. If there are missing or damaged packages, the User must accept the product as damaged, noting this on the delivery note/waybill, and immediately notifying the Operator.

Returns will not be accepted unless return authorisation has been explicitly granted.

The Operator shall not be responsible for lack of delivery or late delivery of goods due to imprecise information provided by the User (e.g. incorrect delivery address), or due to problems after delivery or due to delays ascribable to the carrier.

9 – User Account Closure

The Operator reserves the right to suspend or close user accounts at any time and without prior warning. The Website Operator reserves the undisputed right to prevent access to Afoodtartufi at any time, and without warning, by user accounts which have been subject to payment irregularities or missed payments, repeated order attempts which have not been concluded or any other activity which could explicitly or implicitly lead to direct or indirect damage to the Operator itself.

10 – Prohibited Uses

Users are forbidden from violating, or attempting to violate, the website’s security.
Users must not use the website in a manner such as to cause damage to the site itself, or which could hinder its availability or accessibility, and must not use the site in an illicit, illegal, fraudulent or damaging manner.
It is also forbidden to reproduce, duplicate, copy or resell the service without the Operator’s express permission.

12 – Protection of the Brand and Site Content

All names and marks of the Operator and all other commercial names, illustrations and photos which appear on the websites Afoodtartufi.it and Afoodtruffles.com are the property of the Operator and protected by applicable legislation.

Any use of the same not expressly authorised by the copyright holder shall be liable to legal action.

13 – Modifications to these Terms

The Operator reserves the right to make modifications to these terms of use at any time, providing notice exclusively on the website itself. Users who continue to access the site following publication of such modifications agree implicitly to the new terms.

15 – Applicable Law and Competent Court

Any sale contract between the Website Operator and the User shall be considered to have been made in Italy and shall be subject to Italian law. For the resolution of any disputes relating to the interpretation or execution of these conditions or individual orders, the court of Bologna, Italy shall have sole jurisdiction.
